Ice Miller Defends Warren City Schools Against $2 Million Claim
Ice Miller LLP is pleased to announce the successful defense of a $4 million claim for a tax refund that could have had a devastating effect on Ohio’s Warren City School District and other school districts located in Trumbull County.
A $4 million personal property tax refund was sought by RG Steel Warren, LLC as a claimed successor to WCI Steel, Inc. The claim, if accepted by Auditor Biviano, would have resulted in Trumbull County’s payment of more than $4 million to RG Steel Warren. The impact would have been devastating: Warren City Schools alone would have lost more than $2 million in levy money in school year 2013-2014.
Warren City Schools hired Ice Miller lawyers Colette Gibbons, Rob Stefancin and Dan Anderson to intervene in the action brought by RG Steel Warren. Ice Miller promptly filed a Motion for Summary Judgment setting forth six reasons why RG Steel Warren was not entitled to the tax refund.
In granting the Motion for Summary Judgment, the 11th District Court of Appeals held that the tax refund claim was not payable to RG Steel Warren due to the events that had occurred in the course of the WCI bankruptcy.
RG Steel Warren appealed that decision to the Ohio Supreme Court. The case was pending on appeal when Trumbull County and RG Steel Warren negotiated a final settlement of the claim with RG Steel Warren for the relatively nominal sum of $120,000.00, saving Trumbull County schools and subdivisions nearly $4 million.
