Professional Experience:
Philip Whistler's primary practice concentration is litigating and arbitrating business disputes including antitrust, trade regulation, franchising, corporate and securities litigation and investigations, and shareholder litigation.
Whistler is a partner in the Litigation and Intellectual Property Group. He has over 30 years experience as a trial lawyer concentrating in the area of business litigation.
Whistler has tried numerous jury and non-jury trials in state and federal courts and before administrative agencies covering a variety of subject areas, including antitrust, securities, shareholder derivative actions, RICO, director and officer liability, franchise, dealer and distributor, patent infringement, trademark, UCC, business torts, and other types of business disputes. He has handled significant cases on behalf of Fortune 500 companies, including Shell Oil, DuPont, and Emerson Electric, as well as local and regional companies, governmental agencies and non-profits. He has tried FINRA arbitrations on behalf of brokerage firms, and has represented clients in regulatory investigations involving state and federal securities laws. He has tried commercial arbitration cases before the American Arbitration Association and other alternative dispute resolution bodies. He is also a certified mediator.
Whistler served on the Marion County (Indiana) Judicial Nominating Commission from 1989-1991. He was appointed to the Civil Justice Reform Act Advisory Committee for the U.S. District Court for the Southern District of Indiana in 1992. He served on the Local Rules Advisory Committee for the U.S. District Court for the Southern District of Indiana from 1992-2008. He served as program chair for the Annual Conference of the Seventh Circuit Bar Association in 2009.
Whistler was born in 1952 and was raised in Indianapolis. He graduated in 1974 with a Bachelor of Arts in history, with honors, from Stanford University. After working for the city of Indianapolis Department of Metropolitan Development, he attended Harvard Law School, graduating cum laude in 1978. At Harvard Law School he served on the Board of Student Advisors. He joined Ice Miller upon graduation in 1978.
He is admitted to practice in the state of Indiana, the United States Supreme Court, Seventh Circuit Court of Appeals, and the Northern and Southern Districts of Indiana.
