Full Biography: Philip A. Whistler
Philip Whistler is a partner in the Litigation Section. He has over 28 years experience as a trial lawyer concentrating in the area of business litigation, and is Chair of the Business Litigation practice group.
Trial Experience: In over 28 years in practice, Mr. Whistler has tried numerous jury and non-jury trials in state and federal courts and before administrative agencies covering a variety of subject areas, including antitrust, securities, shareholder derivative actions, RICO, director and officer liability, franchise, dealer and distributor, patent infringement, trademark, UCC, business torts, and other types of business disputes. He has handled significant cases on behalf of Fortune 500 companies, including Shell Oil, DuPont, and Emerson Electric, as well as local and regional companies, governmental agencies and non-profits. He has defended consumer class actions in a number of different industries. He has tried NASD arbitrations on behalf of brokerage firms, and has tried commercial arbitration cases before the American Arbitration Association and other bodies. He is also a certified mediator.
Recognition: Mr. Whistler is listed in Best Lawyers in America in the category of Commercial Litigation. He was recognized as one of the top five business litigators in the State of Indiana in Chambers' America's Leading Business Lawyers, a ranking based on a survey of corporate clients and other practicing business litigation attorneys in the State. He was also named one of Indiana's "Super Lawyers" in the category of Business Litigation in a poll of over 14,000 Indiana attorneys conducted by the Indianapolis Business Journal.
Professional Activities: Mr. Whistler served on the Marion County (Indiana) Judicial Nominating Commission from 1989 to 1991. He was appointed to the Civil Justice Reform Act Advisory Committee for the U.S. District Court for the Southern District of Indiana in 1992. He currently serves on the Local Rules Advisory Committee for the U.S. District Court for the Southern District of Indiana.
He is a member of the ABA Forum Committee on Franchising, and the ABA Sections of Litigation and Antitrust. He is also a member of the Seventh Circuit, Indianapolis and Indiana Bar Associations.
Reported Decisions: Mr. Whistler has over 45 reported decisions in areas including antitrust, director and officer liability, franchise, dealer and distributor, trademark, and patent infringement.
Personal and Educational: Mr. Whistler was born in 1952 and was raised in Indianapolis, Indiana. He graduated in 1974 with a bachelor of arts in history, with honors, from Stanford University. After working for one year for the City of Indianapolis Department of Metropolitan Development, he attended Harvard Law School, graduating cum laude, in 1978. At Harvard Law School he served on the Board of Student Advisors. He joined Ice Miller upon graduation in 1978. He is admitted to practice in the State of Indiana, the Seventh Circuit Court of Appeals, and the Northern and Southern Districts of Indiana.
