Heather Maly is in the Business Litigation and Intellectual Property Group in Ice Miller’s Chicago office.  Her practice focuses on commercial litigation, intellectual property litigation, consumer class action defense, and employment litigation.
Heather represents clients in the media and entertainment, consumer product, health care, fashion, insurance and financial services industries.  She concentrates on litigation arising from commercial disputes that often originate in business transactions, investments and business ownership.  She has litigated a broad range of breach of contract suits and other business torts such as breach of fiduciary duty, tortious interference with contract, and misrepresentation and fraud.
Recently, she represented monoline insurers and financial institutions in disputes centered on mortgage-backed securities transactions and other complex financial instruments.  She has defended a corporation in a director and shareholder dispute in Delaware Chancery Court.  Heather has successfully prosecuted health care fraud claims against a medical practice on behalf of a health care insurance company.  She has been engaged in product liability matters, including defending pharmaceutical manufacturers in various actions in state and federal court.  She has also defended former directors and officers of an international manufacturing company in connection with Civil RICO and fraud claims.
Heather also actively helps clients protect their intellectual property.  She has successfully represented an international company in the health and beauty aid sector to settle a trademark dispute.  In resolving the dispute, the client was able to sell its products in the United States under its international brand name for the first time in over thirty years.  She has also successfully prosecuted trademark infringement actions for beverage and energy companies.
Additionally, she represents companies in litigation arising from their advertising and marketing claims.  She has defended product manufacturers and marketers in actions brought by regulatory agencies in federal courts throughout the country for claims made both in print and online advertisements.

Prior to joining Ice Miller, Heather was an associate at Venable LLP in New York, where she began her practice.
