Philip Whistler is a senior partner in Ice Miller's Litigation and Intellectual Property group. He represents companies and individuals in a wide variety of industries in complex litigation and arbitration involving commercial contracts, corporate governance, trade regulation and securities and finance.

Philip has been recognized in Best Lawyers in America in four different litigation categories; Antitrust, Commercial, Banking and Finance, and Municipal. In three of these – Antitrust, Banking and Finance, and Municipal – he has been named a Best Lawyers Litigator of the Year. He is a "Litigation Star" in Benchmark Litigation and consistently receives the top rating in Chambers & Partners America's Leading Lawyers for Business.

Representative engagements include:

1. Represented a major oil company in antitrust and franchise litigation brought by a group of franchisees

2. Represented a county economic development commission in litigation over a $140 million tax incentive package for construction of a $1 billion steel mill

3. Represented corporate receiver in an eight-figure claim against former directors and outside investment advisors of an insolvent company involving investments in subprime assets

4. Represented broker/dealers in Financial Industry Regulatory Authority, Inc. (FINRA) arbitrations against customers and other registered entities and in state and federal securities regulatory actions and investigations involving a variety of issues such as customer suitability claims, auction rate securities, municipal advisors, failures to supervise and due diligence

5. Represented manufacturer of implantable cardiac defibrillators in trial of $200+ million patent infringement suit

6. Represented wholesale wine industry group in a constitutional challenge to Indiana statutes regulating internet retail sales of wine

7. Represented bearing manufacturer in 2-week jury trial on supply contract

8. Represented Butler University in litigation over the ownership of a historic collection of ballet costumes and music scores

9. Represented the donor of a $25 million gift to a not-for-profit foundation that spent the money contrary to the donor's intent; succeeded in having the Board of Directors of the foundation removed and having a Receiver appointed

He has also represented closely held and public companies and their officers and directors in litigation involving derivative claims and corporate governance.

Philip joined Ice Miller in 1978 after graduating with honors from Harvard Law School where he was a member of the Board of Student Advisors. He is also an honors graduate of Stanford University, with a Bachelor's degree in history. Between college and law school, he worked for the Metropolitan Development Commission of the City of Indianapolis.
