Ice Miller’s OSHA group represents clients in enforcement actions before Federal OSHA, as well as before State OSHA agencies.

These representations include negotiating whether violations occurred; proposed monetary penalties; required abatement actions and abatement dates; as well as litigating some of the largest cases in OSHA’s history. Ice Miller’s OSHA Group also consults with clients regarding compliance matters and assists in preparing and helping to implement safety and health compliance programs.

 In recent representations, Ice Miller has:

  • Represented a refinery where citations exceeding $2,950,000 were reduced by the Administrative Law Judge to $35,000;
  • Established that no combustible dust exposure existed at a papermill;
  • Represented a painting contractor where multi-million dollar citations were reduced by two-thirds by the Occupational Safety & Health Review Commission;
  • Represented numerous businesses and industries in fatality and high gravity cases;
  • Assisted a warehousing operation in successfully resolving a joint investigation by OSHA and Wage and Hour over alleged noise and other safety violations involving students on visas allowing them to work in the U.S.;
  • Coordinated a comprehensive safety and health audit for three facilities of a major retail mail order company;
  • Successfully conducted a month-long ergonomics inspection;
  • Reviewed injury and illness logs for compliance with OSHA’s new recordkeeping regulations and provided guidance on modifying company’s medical management program to avoid over-recording of certain injuries and illnesses;
  • Represented a battery recycling operation in entering into a cooperative compliance agreement affecting employee exposures to airborne lead and cadmium;
  • Advised foundry client in safety inspection related to induction furnace operations.
