Probate Litigation

Controversies can arise in all aspects of estate and trust administration. Ice Miller has represented trusts, estates and beneficiaries of trusts and estates in litigation regarding will contests, will and trust interpretation, breaches of fiduciary duty by the trustee and removal of the trustee, tax disputes with the Internal Revenue Service and the Indiana Department of Revenue, and resolution of disputed claims against estates. Ice Miller has also advised and continues to assist charities with respect to the use of charitable gifts. Finally, Ice Miller has on numerous occasions served as counsel in disputed guardianship matters.
