Benefit Disputes and Litigation

The Employee Retirement Income Security Act of 1974 (ERISA) dictates how most private employers provide health, life and retirement benefits to their employees. However, some benefit plans are not subject to ERISA. These benefit plans have similar, but sometimes differing rules and regulations. Whether your plan is governed by ERISA or not, disputes, claims and litigation may arise. Ice Miller’s Litigation Section and Benefits Group provide dispute resolution and representation in litigation for all types of alleged violations of benefit plans and benefit entitlements. These include alleged breaches of fiduciary responsibility, prohibited transactions and claimed defects in plan administration.
