Environmental Administrative Appeals

Ice Miller handles appeals of orders issued by the Indiana Department of Environmental Management, the Illinois Environmental Protection Agency and the U.S. Environmental Protection Agency to the appropriate administrative agencies and administrative law judges, as well as judicial review of those appeals when necessary.

Recent examples include:

• Appeal of a decision denying reimbursement under Indiana's Underground Storage Tank Excess Liability Trust Fund (ELTF) to a gas station operator that experienced a fuel spill.
• Appeal of the denial of an ELTF claim for a fast food restaurant occupying a former gas station.
