Contaminated Properties - Brownfield Redevelopment
Ice Miller can assist clients with regard to many aspects of Brownfield redevelopment, including:
- Obtaining Comfort and Site Status letters, which are designed to limit the liability of past actions by previous owners so as to encourage an entity to develop a brownfield property
- Obtaining financial assistance, in the form of grants and low-interest loans in conjunction with the Indiana Development Finance Authority or similar program
- Utilizing IDEM's Voluntary Remediation Program ("VRP") to pursue a Certificate of Completion and a Covenant Not to Sue, or similar state programs
- Coordinate with the EPA's Brownfields Economic Redevelopment Initiative
- Aiding in the cleanup of hazardous substances and petroleum utilizing programs such as the IDEM's State Cleanup Program and the Excess Liability Trust Fund
- Assessing potential liability for hazardous substances and petroleum on a potential site
- Coordinating with Ice Miller's Real Estate practice group regarding zoning and land-use issues
- Providing analysis of the Federal Small Business Liability Relief and Brownfields Revitalization Act which was enacted to promote the cleanup and reuse of brownfields, protect brownfield developers, provide financial assistance for brownfields revitalization and enhance State response programs, among other things.
