Drones and FCC Equipment Authorizations

On June 5, 2018, the Federal Communications Commission released an Enforcement Advisory confirming that audio/ video transmitter accessories used with drones must also comply with the Commission’s Equipment Authorization rules before being marketed to U.S. customers. According to the Advisory, the FCC “has observed a growing number of websites that advertise and sell noncompliant radio accessories, specifically audio/video transmitters (AV transmitters), intended for use with drones. Noncompliant AV transmitters are illegal, and they have the potential to interfere with public safety, aviation, and other operations by Federal agencies.”

In 2016, the Federal Communications Commission (“FCC”) unanimously voted to open high-band spectrum for 5th generation (“5G”) wireless expansion. This action will significantly impact connected devices and the Internet of Things (“IoT”), including connected/ autonomous vehicles. While we are still several years from true 5G deployment, this week it “accelerated into reality” according to a blog from Ericcson.

As shared in this post, the Department of Commerce’s National Telecommunications and Information Administration ("NTIA") released a green paper, Fostering the Advancement of the Internet of Things, on January 12, 2017. In the paper, the Department outlines its plans to work on Internet of Things (“IoT”) matters across four broad areas of engagement: enabling the nation’s infrastructure availability and access is one of such areas.
