Ice Miller partner Eric Singer was named Best Lawyers® 2017 “Lawyer of the Year” in Chicago in Litigation – Construction law. Eric is a construction lawyer and litigator, concentrating in contracts, insurance and counseling for construction and design projects, as well as disputes related to real estate, construction, mechanics liens, mortgages, title insurance, easements and injunctions.

We asked Eric: What’s the most unexpected thing you've experienced as an attorney?

“As an associate, a partner introduced me to a new client – a general contractor in need of assistance with a mechanics lien on a complicated project. The project was in trouble, about to be foreclosed or sold and the contractor stood a significant chance of losing his ability to secure payment. In the smallest of small world coincidences, the client turned out to have shared office space with my stepfather many years earlier. They remained good friends and socialized as couples with my folks. The client expressed delight to learn that we were practically related (said in much more colorful ‘contractor’ language) – all of which put more pressure on me to make sure this new lien claim came out well.

“Illinois mechanics lien law has many traps that offer a nearly infinite number of ways to screw up a lien and only a few ways to get it right. It became apparent that to preserve all of the contractor’s rights, the client needed four separate mechanics liens, divided and apportioned among four separate commercial buildings – all within a few days. I got to work and had the liens recorded on time, properly and carefully apportioned among the four buildings.

“A few days later, the client and I were invited to a meeting with counsel for the lenders, developers, title company and investors to “negotiate” the liens. The negotiation was very brief. I confidently explained the validity of the liens, citing chapter and verse, supporting cases and concluded with an amen. We left the meeting with payment in full by title company check. Thrilled with the result, the client picked up the phone and called my mom to tell her I was a great lawyer and that she should be very proud.”
