Reena Bajowala of Ice Miller LLP told Law360 that Rosenbach's question of standing under BIPA is on track with a similar question being asked more broadly across most data collection matters, in terms of determining requirements for plaintiffs to show they have been harmed in order to bring suit.

Part of that discussion, however, stems from companies' desire to stay updated on society's technological advances while individuals are increasingly interested in protecting their personal data, Bajowala said.

"Looking at it as an attorney who advises a lot of companies who are technology-forward, there's a real tension between having increasing efficiencies that come with technology laws that are not quite as cognizant to some of the values to consumers of having some of these technologies available," she said.
