Ice Miller Team Secures Not Guilty Verdict for Wrongfully Convicted Cleveland Man

Ice Miller lawyers secured a not guilty verdict for a Cleveland, Ohio man whose previous conviction stemming from a 2006 drive-by shooting had been overturned by an Ohio Appellate Court after it was determined that he and a co-defendant didn’t receive a fair trial due to prosecutors failing to disclose exculpatory evidence.

Partner Diane Menashe and associates Alex Valdes and Hilary Burger represented Kenny Phillips in the retrial in Cuyahoga County. During the retrial the evidence showed significant inconsistencies in the accounts of the shooting by the various police officers back in 2006, and as a result the jury returned not guilty verdicts in the retrial on all 14 counts.
