H-1B Lottery Registration Closes March 20

Employers who are interested in sponsoring new, cap-subject H-1B workers only have a few days remaining to enter the Fiscal Year 2021 lottery. Employer registration closes at noon on Friday, March 20, and USCIS anticipates lottery selection will occur between March 21 and 31. Employers with cases selected in the lottery will be required to file H-1B petitions within 90 days of selection notification. Cases not selected initially will remain eligible for future selection if enough H-1B petitions are not received and approved to meet the annual limit. If approved, H-1B employment will begin no earlier than October 1, 2020. The H-1B visa classification is widely utilized by U.S. companies to sponsor foreign professionals in a wide variety of industries and specialty occupations, and it is often the only available option for temporary employment in the U.S. The static numerical limit and unknown consequences of the government’s new registration system may leave an even greater number of U.S. employers without options for filling their critical specialty occupation positions.
