White Collar / Government Investigations Health Care Fraud and Abuse

Health care fraud is a major focus of federal and state law enforcement.

In FY 2014 alone, the Department of Justice filed 165 new health care fraud cases involving charges against 353 defendants; obtained 304 guilty pleas; litigated 38 jury trials; and secured prison sentences in health care fraud cases averaging more than 50 months. CMS has even established a command center with experts from different agencies who work together to help detect potential fraud. At the state level, the various Attorneys General pursue investigations and criminal sanctions for violations pertaining to the Medicaid program.
Criminal penalties are severe. Conviction for a health care-related crime can result in a lengthy prison sentence, a large fine, restitution, license revocation and exclusion from participation in state and federal health care programs. A criminal investigation alone can threaten the professional viability of the targeted individual or entity.
Criminal litigation is nothing like civil litigation. The criminal process is unique and full of traps for the unwary.   • Obtained dismissal of all charges brought by a state prosecutor against a physician alleging improper prescribing of buprenorphine; charges included delivery of controlled substances and Indiana’s Corrupt Business Influence (Indiana RICO) statute.
  • Represented national health care drug and device manufacturers in investigations and litigation concerning Medicare, Medicaid, and private insurance
  • Represented a pharmacist in a state and federal Medicaid fraud investigation
  • Represented a chiropractor in a workers’ compensation fraud investigation
  • Represented health care providers in investigations and litigation involving the DEA and state pharmacy boards
