Consequences of Hire American Executive Order

The President’s Executive Order on Buy American, Hire American directs federal agencies to protect the U.S. workforce through changes to the employment-based immigration system, particularly the H-1B program. We will explore current policy changes already underway, such as promotion of the federal e-verify program, reinterpretation of what qualifies as an H-1B specialty occupation and elimination of deference on previous immigration decisions. We also will discuss potential changes that could occur under this EO, including changes to the H-1B lottery system, shifting to a merit-based immigration system and increased employer penalties for fraud and abuse.
