John D. Giampolo is a partner in Ice Miller’s Bankruptcy and Restructuring Practice Group, focusing his practice on core bankruptcy and related litigations and transactions.

He represents corporate debtors, trustees, secured lenders, hedge funds, bondholders, trade creditors, Chapter 11 debtors, private equity funds and other parties in such interests as workouts, distressed debt restructuring, receiverships, Section 363 asset sales, bankruptcy debtor-in-possession (DIP) financing, Chapter 11 reorganizations, Chapter 7 liquidations, bankruptcy claims trading, claim objections, assignments for the benefit of creditors and insolvency proceedings under the Securities Investor Protection Act (SIPA).

In his practice, John prosecutes and defends Ponzi scheme litigation, avoidance actions and other clawback actions in bankruptcy and other bankruptcy-related litigation. He also has a strong focus on litigation outside of bankruptcy in employment law, securities, antitrust, unfair competition and other complex high stakes commercial litigation disputes in federal and state courts in New York, New Jersey, Delaware and in arbitration proceedings.

John is one of the founding members of Ice Miller’s Distressed Investment Group (“DIG”), which focuses on distressed investment strategies and transactions, including transactions in connection with bankruptcy, in-court restructurings, out-of-court restructurings, foreclosures and other insolvency-related transactions. John has more than 15 years of experience representing clients in connection with distressed assets and other special situations investment strategies, including loan-to-own strategies, debt restructurings, debtor-in-possession financings, claims trading, distressed real estate acquisitions, section 363 sales and other investment situations. Click here for more information on DIG

Additionally, John focuses on corporate matters and serves as outside general counsel to companies in various industries, including handling various day-to-day legal matters, employment law matters, business strategy, and pre-litigation counseling. He also has extensive experience in employment law representing clients in connection to negotiating employment, executive compensation, non-compete agreements and litigating employment disputes.

In 2004, John earned his juris doctor, cum laude, from the Southwestern University School of Law, where he was a member of the Southwestern Journal of Law & Trade. He received his Bachelor of Science in business administration from Villanova University in 2001.

John is licensed to practice law in New York and New Jersey State Courts, the U.S. District Courts of the Southern District of New York and District of New Jersey and has appeared in the U.S. Bankruptcy Courts of Delaware, Illinois, Indiana, North Carolina and other jurisdictions for select matters.
