Pat Devine is a senior counsel in Ice Miller's Litigation Group. The focus of his practice is construction and project delivery methods with emphasis in contract, prevailing wage, and competitive bid disputes.

Pat's background as a former Ohio assistant attorney general, in addition to his current practice, provides a unique combination of private and public sector experience. Pat advises his clients regarding project delivery systems, competitive bidding issues, contractor requirements, workers’ compensation, prevailing wage compliance and public contract law in an effective and efficient manner. Devine’s depth and breadth of legal experience combined with his superior level of professional integrity has earned him Martindale Hubbell’s highest rating. He has earned the professional accreditation of LEED Green Associate.

Pat has argued numerous cases before the Ohio Supreme Court, all state courts of appeals, the United States Sixth Circuit Court of Appeals, and he has submitted briefs to the United States Supreme Court. He has represented the executive offices of the State of Ohio, the Ohio Department of Transportation, the Ohio Bureau of Employment Services and regulatory bodies including, the Ohio Real Estate Commission, the Ohio State Racing Commission.

In addition to representing a trade association of heavy/highway contractors, Pat advises contractors and owners on construction issues, including project labor agreements, mechanics’ lien law, and regulatory compliance.

Pat is a frequent lecturer on prevailing wage issues, public contracting, mechanics’ lien law. He has authored and edits Chapter 5 “State Appeals and Other Challenges to State and Local Administrative Actions” in the Ohio Administrative Law Handbook, as well as numerous articles on construction and employment related issues.
Representative Transactions
  • Successfully represented contractors in competitive bidding, and prevailing wage litigation.
  • Represented highway contractor in an award of bid preparation costs.
  • Represented a steel erector contractor in a breach of contract case; resulted in jury trial award in Hamilton County for six figures.
  • Represented a heavy highway contractor and prepared a successful appeal for the contractor's price adjustment from the Ohio Department of Transportation's Review Committee for nonspecification of materials.
  • Represented heavy highway contractor before the Ohio Department of Transportation's Director's Claim Board and successfully recovered lost timber value and differing site conditions claims.
  • Successfully represented several woman-owned businesses before the Ohio Department of Transportation to obtain/retain the Disadvantaged Business Enterprise (DBE) certification.
  • Successful jury verdicts in workers' compensation cases.
