Salvatore Guerriero is an attorney in Ice Miller’s Intellectual Property Group, where he represents clients in the pharmaceutical, food, banking, transportation, consumer goods, software, publishing, jewelry and mass retail industries. He regularly handles high-stakes cases for plaintiffs and defendants in patent, copyright, trademark and trade secrets litigation, as well as other commercial disputes.

Sal advises his clients on trademark protection and maintenance, including searching, clearing, filing and prosecuting domestic and international applications. He has substantial experience practicing ex parte and opposition and cancellation matters in front of the U.S. Patent and Trademark Office’s Trademark Trial and Appeal Board. Sal also assists clients with Internet domain disputes and all areas of copyright law.

In his 20+ years of practicing IP law, he has been involved in more than 50 opposition and cancellation matters before the USPTO Trademark Trial and Appeal Board; more than 100 federal litigation matters involving patents, copyrights, trademarks and trade secrets; and more than 100 trademark application prosecutions.

  • Boehringer Ingelheim Pharmaceuticals Inc. v. HEC Pharm Co. Ltd., No. 15-cv-05982 (D.N.J). Represented InvaGen Pharmaceuticals in obtaining favorable settlement in patent infringement litigation related to DPP-IV inhibitors and metformin for the treatment of Type II diabetes. Team spearheaded invalidity experts at trial; final judgement relied heavily on team’s experts.
  • Wawa, Inc., et al. v. Dawa Food Inc., et al., No. 17-cv-00551 (D.N.J). Represented Wawa, Inc. and Wild Goose Holding Co., Inc. in obtaining favorable consent judgement in trademark infringement suit involving famous WAWA name and trademark.
  • Roxane Laboratories, Inc. v. Camber Pharmaceuticals, Inc., et al., No. 14-cv-04042 (D.N.J). Represented InvaGen Pharmaceuticals and Camber Pharmaceuticals obtaining total win, including nearly $2 million in attorneys’ fees and costs, in patent infringement litigation over patent for calcium acetate capsules.
  • Alliance Bank v. New Century Bank, No. 2;10-cv-02249 (E.D. Pa.). Represented Alliance Bank in obtaining preliminary injunction against competitor in trademark infringement suit involving Alliance Bank’s mark CUSTOMERS FIRST for its flagship checking product.
  • Ethidium Health Systems, LLC v. Take Care Health Systems, LLC et al., 06-cv-3061 (E.D. Pa.). Represented Ethidium Health Systems in obtaining favorable settlement in copyright infringement lawsuit involving proprietary medical record system software.
  • Asian World of Martial Arts Inc. v. Texas Int’l Property Assocs., WIPO Case No. D2007-1415. Represented Asian World of Martial Arts Inc. in successfully obtaining transfer of domain name in widely cited UDRP proceeding.
  • Diamonique Corp. v. Diamonair USA, Inc., Opposition No. 91163668 (TTAB 2004). Represented Diamonique Corp. in obtaining sustained opposition on behalf of well-known cubic zirconia jeweler after full administrative trial.
  • Meta/Balance, Inc. v. Health Ventures Partners, No. 03-cv-50497 (N.D. Ill.). Represented Health Ventures Partners in connection with the dismissal of declaratory judgement action based upon filing of opposition proceedings before TTAB. Obtained favorable settlement for Health Ventures Partners, including withdrawal of involved trademark application.
