Ice Miller attorneys regularly represent lenders, investors and financial services firms. 

We assist in structuring transactions in order to minimize threats to the secured position that the lender seeks to obtain, to maximize options upon default and to identify and address bankruptcy risks.  We also advise our clients regarding the vast range of issues that arise when a borrower becomes financially distressed or unable to meet its financial obligations and assist with restructurings, asset sales, fraud against the lender, workouts, foreclosures and receiverships and in defending preference and other bankruptcy Chapter 5 claims.

  • Lead counsel to mezzanine lender in connection with the bankruptcy proceedings of a former franchisee of a chain of fast casual restaurants. Litigated issues include claims of former franchisor related to post-termination rights and attempted sale of assets to mezzanine lender. Decision on these issues is reported at In re Flour City Bagels, LLC, 2016 WL 4595487 (Bankr. W.D.N.Y., Sep. 2, 2016).
  • Represented secured creditors and lenders in the reorganization of a luxury golf course community in Central Indiana.
  • Represented a multinational secured lender in connection with $15 million in secured indebtedness in the Chapter 11 bankruptcy of the largest mobile home park in the Midwest.
  • Celtic Capital Corporation:  Represented Celtic Capital Corporation in connection with recovery under Article 9 of collateral for asset-based lending and in negotiation and documentation of the sale of Celtic’s position.
  • Integra Bank:  Assisted this Indiana financial institution in addressing the insolvency of a convenience store business with over 60 locations in three states, protecting and obtaining a favorable resolution in bankruptcy court.
