Indiana law provides that certain construction and renovation projects be approved through a petition-remonstrance process or "race."
Since 1937, when the petition-remonstrance process was enacted into the law, Ice Miller has worked with the vast maturity of governmental entities, especially school corporations, that have prepared for and run a petition-remonstrance race. This is a very unique area of the law. With each government that have worked on a petition-remonstrance race, we have gained essential experience and insights.
When serving as bond counsel on these types of projects, we do not merely provide a bond counsel opinion at the time of the closing on the bonds or draft financing documents, we provide advice and guidance on the legal and political process which includes everything from working with the county auditor to make sure the correct petition is used, to advising on the restrictions in using school facilities to promote the project to strategies to collect the most signatures.
