State Revolving Fund

Ice Miller has substantial knowledge of the federal rules and regulations that govern state revolving fund loan programs nationally, having been involved with the formation of Indiana's SRF Loan Program in the early 1990s. 

Ice Miller is familiar with EPA's rules, regulations and guidance and is also well versed in the federal tax and security rules that govern the issuance of municipal bonds, which provides Ice Miller with a unique perspective to advise "leveraged" SRF Loan Programs. 

In Indiana, Ice Miller has served as bond counsel to the State Revolving Fund (SRF) Loan Programs for all financings and has been an advisor to the programs since the Programs' inception, including assisting with the drafting of the programs' authorizing legislation and the program's debt issuance, and most recently, serving as bond counsel to the Indiana Finance Authority in a transaction to use SRF assets to leverage a $436 million loan from the EPA under the Water Infrastructure Finance and Innovation Act (WIFIA); at that time, the largest initial disbursement under WIFIA.

Ice Miller's public finance attorneys have also represented numerous water and wastewater utilities with their negotiated borrowings from the SRF Loan Programs, having closed dozens  borrower loans with the SRF Loan Programs over the past 20 plus years.  These utilities include sanitary, conservancy, storm water and regional districts in addition to dozens of municipalities.
