Ice Miller’s Workplace Solutions Group provides full-service immigration counsel related to the hiring and retention of key foreign national professionals, managers, and executives. 

Focused exclusively in this area of law, our Immigration practice prepares and pursues all varieties of temporary non-immigrant status. This includes full service as related to the following visa categories: B-1, E-1/E-2, F, H-1B (cap and cap-exempt), J-1 (including Conrad, no objection, and hardship waivers), L-1, O, P, R, and TN. We prepare and file petitions with U.S. Citizenship and Immigration Services (from new petitions to changes or extensions of status to transfers or change of employer petitions), coordinate visa applications with U.S. Embassies and Consulates worldwide and ensure smooth entry into the United States with Customs and Border Protection.

In addition, we handle all types of lawful permanent residence (green card) applications with USCIS and via consular processing, including those based on PERM Labor Certification (regular, special handling, and supervised recruitment), National Interest Waivers, and on behalf of Schedule A, Group I Workers, Religious Workers, Multinational Managers and Executives, Outstanding Professors, Researchers and Aliens of Extraordinary Ability.

We counsel employers with respect to unique issues that may arise in connection with foreign travel, security clearances, driver's licenses, Social Security numbers, age-out situations for dependent children, consequences of corporate restructuring, H-1B and permanent residency portability, changes in employment that may affect immigration status, and maintenance of permanent residence. We also have extensive experience developing and implementing unique immigration strategies for time-strapped H-1B workers through the use of AC21 measures and temporary opportunities abroad to recapture additional time in the United States with minimal interruptions to employee and sponsoring employer.

We work closely with clients to help them hire and retain key employees by providing counsel throughout interviewing of foreign national candidates, pre- and post-offer discussions regarding immigration needs and strategy, and by managing employee and manager expectations with respect to immigration benefits.
