Ice Miller partner Tim Belevetz was featured in the Bloomberg Law article, “Short Seller Left Seeks Mistrial Over 'Unusual' Courtroom Error.”

Irregularities involving jury deliberations and verdict forms are always taken seriously, said Timothy Belevetz, a former federal prosecutor and white-collar defense lawyer at Ice Miller who wasn't involved in the case.

"There's no questions this is unusual," Belevetz said. "Typically, the prosecution drafts the jury form and gives it to the defense to review. Both sides would have seen it before it was given to the jury."

Belevetz, the former federal prosecutor, said the correct jury verdict — finding Left guilty on some counts and not guilty on others — shows the jury was paying close attention to the case and ultimately convicted Left on the same counts of securities fraud, notwithstanding their use of the wrong form.

“In addition, they acquitted on some of the securities fraud counts,” Belevetz said. “With or without the erroneous verdict form, they said Left was guilty on certain counts and not guilty on others, which suggests they carefully and independently considered the evidence supporting each count in reaching a verdict.”
