This proclamation provides, effective June 8, 2026, tariff rates that are reduced to 15% on agricultural equipment, certain residential HVAC systems and components, and industrial equipment such as bulldozers and forklifts. The Treasury Department must also propose within 90 days strengthened Bank Secrecy Act (BSA) customer due diligence rules and, within 180 days, consider changes to BSA customer identification program requirements — particularly regarding foreign consular identification cards.

Ending Market Distorting Subsidies for Unreliable, Foreign‑Controlled Energy Sources

The executive order “Ending Market Distorting Subsidies for Unreliable, Foreign-Controlled Energy Sources” marks a significant policy shift in the federal government’s approach to renewable energy incentives. Framed as a national security and economic reliability measure, the order directs federal agencies, in particular the Department of the Treasury, to take immediate steps to phase out tax credits for wind and solar energy projects, particularly those that rely on foreign supply chains or are deemed “expensive and unreliable” for grid stability.
 

At the heart of the order is a directive to terminate the clean electricity production and investment tax credits under Sections 45Y and 48E of the Internal Revenue Code. These credits have been central to the growth of the renewable energy sector in the United States. The order specifically targets the “5% safe harbor” provision, which is a long-standing Internal Revenue Service (IRS) guideline recently reaffirmed in IRS Notice 2021-41 — that a project is deemed to have “begun construction” if it has incurred 5% of total project costs — and has been widely used by solar and wind developers to “lock in” eligibility for tax credits even before construction begins in earnest.
 

The 5% safe harbor was designed to provide flexibility and certainty in project planning. For example, a solar developer could purchase panels or sign engineering contracts that amount to 5% of the total project cost, and thereby establish that the project had “begun construction” for tax purposes. This allowed developers to secure financing and move forward with confidence, even if the physical build-out would not occur for months or years. The safe harbor also played a critical role in attracting tax equity investors, who rely on predictable credit eligibility to structure financing deals.
 

However, the order casts doubt on the continued viability of this approach. Section 3 instructs the Treasury Secretary to issue new or revised guidance by August 18, 2025, that would restrict the use of broad safe harbors unless a “substantial portion” of the facility has been physically constructed. This language suggests a move away from cost-incurrence as a proxy for construction activity, and toward a more stringent, progress-based standard. In effect, the order could invalidate the IRS’s most recent guidance on the 5% safe harbor, creating significant uncertainty for projects that have not yet broken ground — and for those that have.
 

The implications of this policy shift are far-reaching. Solar and wind developers are likely to be the most directly affected, especially those in the early stages of project development who were relying on the 5% rule to preserve tax credit eligibility. Commercial real estate owners, such as malls, shopping centers, grocers, and warehouses operators who have invested in rooftop solar installations, may also face higher capital costs and longer payback periods. Tax equity investors could see increased regulatory risk, potentially reducing their appetite for renewable energy deals or demanding higher returns. Additionally, engineering, procurement, and construction (EPC) contractors and supply chain vendors, particularly those sourcing components from foreign manufacturers, may experience a slowdown in demand.
 

In the short term, developers may need to accelerate construction timelines, restructure financing, or even reassess project viability. In the longer term, the order could lead to a broader reallocation of capital away from renewables and a return to fossil fuels or nuclear projects, likely slowing the pace of decarbonization and complicating state-level clean energy mandates.

This executive order establishes policies and procedures for the Department of Defense and Department of Homeland Security to secure the borders of the United States through physical barriers and increased personnel presence, apprehend and detain undocumented immigrants until they can be removed from the United States, and terminate parole programs that are inconsistent with the policies of the order. The executive order also requires the Secretary of State to facilitate international agreements whereby asylum seekers would remain in Mexico while their case is pending. The Attorney General is to prioritize the prosecution of offenses that relate to the border.

This executive order restores a category of federal workers known as ”Schedule F” that existed in the prior Trump administration under EO 13957. Schedule F employees lack the same job protections typically enjoyed by career civil servants, including procedures and appeals rights for termination. The Director of the United States Office of Personnel Management (OPM) is directed to amend applicable regulations to enact the above change and issue guidance, within 30 days, about additional categories of positions for this determination.

This executive order announces the United States’ intent to withdraw from the World Health Organization (WHO). It revokes Executive Order 13987, pauses the transfer of any government funds to the WHO, and recalls/reassigns government personnel and contractors working in any capacity with the WHO. The order requires the review and replacement of the 2024 U.S. Global Health Security Strategy as soon as practicable.

This executive order instructs the Attorney General to commute the sentences for 14 named individuals and issue pardons to all individuals convicted of offenses at or near the U.S. Capitol on January 6, 2021. Further, the Bureau of Prisons shall release individuals convicted of offenses at or near the U.S. Capitol on January 6, 2021, who are currently incarcerated. Lastly, the Attorney General is directed to seek dismissals with prejudice for all pending indictments against individuals for conduct at or near the U.S. Capitol on January 6, 2021. 

Regulatory Freeze Pending Review

This executive order halts any new rules from being published in the Federal Register until a Trump appointee can review and approve. It also, directs federal agencies to consider postponing the effective date of any new rule published in the Federal Register for 60 days to provide an additional public comment period and review by Trump appointees. 

The Organization for Economic Co-operation and Development (OECD) Global Tax Deal (Global Tax Deal)

This memorandum declares that the OECD Global Tax Deal, agreed to by the previous administration, has no effect in the United States without Congressional approval. It directs an investigation into potentially discriminatory foreign tax practices and the development of protective measures for American businesses. 

Organization of the National Security Council and Subcommittees

This National Security Presidential Memorandum (NSPM) reorganizes the National Security Council (NSC) system, outlining its structure, membership, functions, and processes for national security and homeland security policy development and implementation. It emphasizes a comprehensive and integrated approach to address evolving national security challenges. 

Memorandum to Resolve the Backlog of Security Clearances for Executive Office of the President Personnel

This memo states that all personnel for the Executive Office of the President (EOP) shall immediately be granted interim Top Secret/Sensitive Compartmented Information (TS/SCI) security clearances for a period not to exceed six months and shall be immediately granted access to the facilities and technology necessary to perform duties. 

Putting People Over Fish: Stopping Radical Environmentalism to Provide Water to Southern California

The executive order routes water from the Sacramento-San Joaquin Delta to other parts of California. 

Restoring Accountability for Career Senior Executives

Within 30 days, the Director of the Office of Personnel Management (OPM), in coordination with the Director of the Office of Management and Budget (OMB), shall issue SES Performance Plans that federal agencies must adopt. All agency heads shall reinvigorate the SES System, to include terminating and replacing the current Executive Resources Board and Performance Review Boards. 

Hiring Freeze

This executive order directs a hiring freeze for all federal civilian employees, to be applied through the executive branch. No vacancies may be further filled, or new positions created until the freeze is lifted. This freeze does not apply to military personnel; positions related to immigrant enforcement, national security, or public safety; anything that may adversely impact the provision of Social Security, Medicare, or Veteran’s benefits; nomination and appointment of officials; or any exceptions deemed necessary by the Director of the Office of Personnel Management (OPM). Within 90 days, the Director of the Office of Management and Budget (OMB), in consultation with the director of OPM and the Administrator of the United States Digital Service (USDS), shall submit a plan to reduce the federal workforce, at which time the freeze will be lifted for all federal agencies and departments except for the Internal Revenue Service (IRS). Contracting outside the federal government to circumvent this memorandum is prohibited. 

Return to In-Person Work

This executive order directs the heads of all departments and agencies in the executive branch to take steps to terminate remote work arrangements and require employees to work in-person full time, provided that necessary exceptions are made. 

America First Trade Policy

This executive order requires investigations to be conducted by the Department of the Treasury, the Department of Commerce, and the Trade Representative relating to trade deficits in goods, the establishment of an External Revenue Service to collect tariffs and other foreign trade-related revenues, and the impact related to participation in U.S.-Mexico-Canada Agreement. The executive order delivers emergency price relief consistent with applicable law, including lowering the cost of housing, healthcare costs, costs of home appliances, and costs of food and fuel. It also requires the creation of employment opportunities for American workers. 

Guaranteeing the States Protection Against Invasion

This proclamation declares an "invasion" at the southern border of the United States due to the high number of undocumented immigrants entering the country. It invokes presidential powers to suspend the entry of certain migrants and directs actions to repel the "invasion," citing national sovereignty, public health, safety, and national security concerns. 

Flying the Flag of the United States at Full-Staff on Inauguration Day

This proclamation declares that the American Flag must be flown at full staff for Trump's and all future inaugurations at all public federal facilities, military bases, naval vessels, etc. The proclamation also directs the flag to go back to half-staff for the period of mourning for President Carter.
