Higher Education

Ice Miller has committed substantial resources and personnel to build one of the largest higher education practices in the nation. We have the privilege of serving as general counsel to some institutions while providing specialty services to others. 

Ice Miller attorneys have served over 250 higher education clients across 39 states. Our clients cover the spectrum of higher education, from state-wide higher education systems, large public research institutions, private universities and colleges, medical and professional schools and faith-based institutions, to athletic conferences, lobby and trade associations, support foundations, research foundations, philanthropic entities, and individual higher education leaders. 
 
In addition to general higher education law, Ice Miller’s Higher Education practice commits the Firm’s resources to serve its higher education clients on issues related to every aspect of the business of higher education, including collegiate sports, construction, employment law, student issues, employee benefits, immigration, international law, information technology, and municipal finance. Some examples of recent projects that we have worked on include:
 
  • Fair Labor Standards Act (FLSA) self-audits for higher education clients and attention to the 2016 regulations on the higher education environment. In addition, analyzing the NLRB’s new decision on graduate students as “employees” and putting in motion methods of working with the impact of this decision. 
  • Consulted with both public and private institutions on fiduciary duties and best practices related to their retirement plan structures and investments.
  • Worked on behalf of large higher education institutions regarding Americans with Disabilities (ADA) website compliance and Title IX compliance and litigation. 
  • In the past 10 years, we have served as bond or underwriter’s counsel on almost 200 transactions for 60 higher education clients in 12 states, totaling more than $6.25 billion. 
In addition, Ice Miller’s attorneys regularly publish and present in national forums directed to colleges and universities, and serve on committees and in leadership positions with organizations such as the National Association of College and University Business Officers (NACUBO), the National Association of College and University Attorneys (NACUA), and the College and University Professional Association for Human Resources (CUPA-HR). Ice Miller uses its involvement in these and other groups to prepare ourselves to serve its clients at the highest levels.
