Anastasia Tonello, who joined Ice Miller’s immigration practice as a partner in October, said in an interview that her work handling employer-side immigration issues has been significantly more chaotic in the last year, thanks to the increased immigration raids at workplaces and the fear those raids instill in employers, even if they are following the law.

“I think that all of this is designed to create panic and chaos, which makes it very difficult to clean up and to get people whatever counsel they need and are entitled to,” Tonello said. “When they're being rounded up in these mass actions, it does complicate things for those that actually do have some remedy or really weren't supposed to be part of this.”

Tonello said that part of her work is shoring up any potential errors that under prior administrations would be accepted as simple mistakes but now may yield serious consequences.

“It's more on the radar for companies that are both just doing business and want to make sure that they're doing everything right,” Tonello said. “And if they're not, how can they? It's incredible how many errors are in I-9 employer verification process. I think employers never really worried about it because the chances of getting any kind of penalty were viewed as relatively small.”
