Ice Miller partner Tim Belevetz was featured in the Law.com article, “Mixed Verdict, Alleged Jury Bias Expected to Be Focus of Musk Securities Appeals, Experts Say.” The article examines the mixed jury verdict in litigation surrounding Elon Musk’s acquisition of Twitter and the potential role of alleged jury bias in post-trial motions and appeals.

“Plaintiffs’ counsel is likely to look at that and say, because it’s a mixed verdict, that tends to disprove this notion that they were out to get him,” Belevetz said. 
 
Belevetz said while the case has provided a look at the relatively new phenomenon of statements made on high-profile social media accounts such as Musk’s X account being subject to securities fraud claims, the case doesn’t raise any issues of first impression, and it’s likely Musk’s arguments on appeal will again center on his alleged inability to have gotten a fair trial in the Bay Area.  
 
“I think it was probably meant as a joke, but the question is, does it rise to the level of prejudice in such a way that the verdict has to be set aside?” Belevetz said of the verdict form. “That issue, standing by itself, is going to be a tough one to convince the appellate court on.”
