Nicholas Casto is a partner in Ice Miller's Litigation Group.
Nick’s practice focuses on resolving disputes on behalf of clients in a variety of industries, including companies in the manufacturing and private equity sectors. Nick represents clients in lawsuits involving their agreements with customers, partners, distributors, licensees, and employees. He also regularly defends clients against other claims arising out of their commercial relationships, including fraud, breach of fiduciary duty and business torts. Additionally, Nick works with clients to protect their trade secrets and other intellectual property associated with their businesses.
Nick also frequently represents clients in disputes arising out of M&A transactions, including disputes involving breaches of representations and warranties and earnout provisions. Nick helps clients understand their rights under purchase agreements, guides their decision-making when issues arise after a deal closes, and advocates on their behalf in litigation.
In addition to his commercial background, Nick also has significant experience defending manufacturers in products liability lawsuits. He regularly works with clients to help them avoid judgments in cases involving recreational equipment, medical devices, and industrial machinery.
Nick has substantial experience in all stages of litigation and has helped secure important trial victories for clients. For example, Nick successfully obtained a permanent injunction and damages at trial on behalf of a manufacturer in a dispute with one of its former distributors. Nick was also part of a team that achieved a defense verdict for a client accused of breaching a joint venture agreement, and helped successfully obtain a judgment in a jury trial for a commodity seller in a dispute over a long-term supply agreement.
Nick graduated from the University of Michigan, with distinction, in 2009, with a B.A. in English. He received his J.D., cum laude, from the University of Michigan Law School in 2012. While in law school, Nick served as a contributing editor for the Michigan Journal of Law Reform and as a legal intern at the Ann Arbor City Attorney's Office.
Outside of his legal practice, Nick currently serves as the President of the Chicago Public Library Foundation’s Associate Board.
