Our Aerospace & Defense Team includes attorneys and industry professionals with a variety of backgrounds from multiple offices, including Washington, D.C. We represent aerospace & defense companies across the country, regularly providing practical and industry-relevant advice in the following areas:  
 
  • Federal Contracts and Government Procurement. The government procurement process demands knowledgeable and savvy business partners to successfully win contracts. Our team works with clients to identify potential procurement opportunities, facilitate introductions to decision makers and potential teaming partners, and ultimately draft comprehensive proposals in support of our client’s interests.  
  • Bid Protests. Bid protests are an inevitable part of doing business with the government, and we represent contractors in protests before federal agencies, the Government Accountability Office (GAO), and the United States Court of Federal Claims. In addition, our group also represents clients in state and local procurement award protests.   
  • Claims and Disputes. Disputes between the government, prime contractors, and subcontractors can be unavoidable. When disputes arise, our team helps contractors protect their rights under the Contract Disputes Act, which contains mandatory requirements for asserting claims against the government. When claims cannot be amicably resolved, we represent contractors in litigation before the United States Court of Federal Claims, the Armed Services Board of Contract Appeals, and the Civilian Board of Contract Appeals.  
  • Data Security and Privacy. Our team provides end-to-end coverage of privacy and data security issues for aerospace & defense companies. We aid clients in developing information privacy and security programs and provide counsel to government contractors as to the unique cybersecurity requirements applicable to contractors possessing or using government data. Our attorneys have experience aligning information security and privacy programs with Department of Defense contractor requirements, including NIST SP 800-171 and other requirements found in DFARS 225.204-7012.  
  • Intellectual Property, Data Rights, and the Protection of Trade Secrets. Our team offers a full range of IP legal services, including preparation, filing, and prosecution of patent, trademark, and copyright applications. We also prepare and negotiate licenses and other contracts for the protection or commercialization of IP assets. Further, our team uses its deep understanding of the Federal Acquisition Regulation (FAR) and the Defense Acquisition Regulation Supplement (DFARS) to help clients protect their intellectual property when they contract with the government.
  • Internal Investigations and the False Claims Act. Ice Miller attorneys have defended clients in numerous False Claims Act investigations and lawsuits. Our experience includes significant claims involving the pharmaceutical, defense, health care and student financial aid industries. We have represented clients in civil lawsuits, civil and criminal investigations, jury trials, and at the appellate level.
  • International Trade. Our team counsels aerospace & defense companies on international trade, regulatory compliance, investigations, commercial agreements and foreign investment. We provide comprehensive legal services to help our clients navigate the International Traffic in Arms Regulations (ITAR), the Bureau of Industry and Security (BIS), the Office of Foreign Assets Control (OFAC), the North American Free Trade Agreement (NAFTA), and the Foreign Corrupt Practices Act (FCPA).
  • Labor & Employment and Immigration. Our team represents government contractors in their efforts to comply with the Service Contract Act; the Davis-Bacon Act; the Fair Labor Standards Act; Executive Orders; and federal, state and local statutes, regulations and ordinances related to affirmative action. We also represent a large and diverse group of companies worldwide with respect to all of their immigration and global relocation needs.
  • Mergers and Acquisitions. Our team provides comprehensive legal services for transactions involving all aspects of buying, selling, and combining businesses and entities, including related equity, debt, and mezzanine financings. Our clients are strategic buyers and sellers and financial buyers and sellers, including private equity funds, as well as not-for-profit organizations and governmental authorities.
  • Economic Development. Our team represents both government entities and private sector companies in the negotiation of economic development incentive packages, from the earliest stages of site selection to contract structuring and ongoing compliance with federal, state, and local laws.

Our team brings in-depth experience and knowledge of the Congressional Military Construction (MilCon) Committees and the Base Realignment and Closure (BRAC) processes, with a particular focus on advocacy of maximizing military installations’ mission potential and identifying the economic development opportunities the process provides to neighboring communities. In addition, when base closures occur, our team helps contractors protect their rights under the FAR and DFARS.
  • Small Business Set-Asides, Joint Ventures, and other Strategic Alliances. Our team has significant experience with issues arising under the various small business set-aside programs administered by the United States Small Business Administration. Further, we help large and small businesses take advantage of set-aside opportunities through joint ventures, mentor-protégé agreements, and other strategic alliances.
