Ice Miller's Health Law Group represents clients on a variety of health transactions and business issues, as well as regulatory, compliance and litigation matters.
 


Our team includes a lawyer who is a former Indiana Supreme Court Justice, lawyers who are leaders in the ABA Health Law Section and the American Health Lawyers Association, a former Assistant United States Attorney, a nurse/lawyer, former in-house counsel for a health system, a national hospice company and a community mental health center. Ice Miller serves a broad spectrum of health care entities.

Representative Experience

  • Corporate transactions and joint ventures, including advice regarding potential tax, fraud and abuse, licensure, antitrust, and governmental intervention and/or involvement; and structuring transactions to address such issues as:
    • ​advising clients in strategic planning and new project feasibility
    • preparation of all related documents and addressing post-closing matter
    • ongoing representation of entities, including assisting in enrollment in governmental programs and with private payors
  • Review and counseling regarding existing and new financial and contractual relationships in light of the continually evolving health care laws and regulations.
  • Counsel regarding fraud and abuse laws and regulations, such as Stark, anti-kickback, civil monetary penalties, in both contractual and joint venture relationships, and assisting in structuring such relationships in order to address and manage related risks
  • Counsel regarding compliance issues and assisting on internal investigations including whistleblower matters
  • Governmental program reimbursement issues and in addressing other payor issues
  • Various risk management matters including patient issues
  • Litigation matters in court and in alternative dispute resolution
  • Peer review and medical staff matters
  • Privacy issues, including compliance with HIPAA and various state privacy laws and addressing breach issues
  • EMTALA and other ER requirements
  • Tax-exempt issues
  • Coordinating work with consultants, accountants and local counsel
  • Various divestiture matters
  • Experience with federal and state governmental agencies
  • Counsel on existing and pending federal and state legislation and regulations and their impact on the client and its operations and, when appropriate, assisting in lobbying efforts to impact legislation and regulations
  • Counsel on employment and employee benefit matters
  • Health care financing
