IHA’s Legal Forum is a one-day conference designed for hospital attorneys and executives, as well as those interested in legal topics relating to health care, and offers insight into a wide range of health care legal issues. Health care is data, and data is health care. In our era of big data and advances in data analytics, personal data is increasingly being used by health care organizations to inform value-based care and deliver evidence-based information to improve the quality of care. At the same time, health care organization are increasingly the targets of cyberattacks such ransomware and phishing attempts. This seminar will describe how these factors contribute to ever-increasing data privacy and security risks especially in the context of health care transactions and the processes for managing those risks during the lifecycle of the transaction. Speakers will address, among other topics: Privacy and security risks from the point of view of health care transaction counsel, including risks related to uses of PHI for AI technology development; due diligence–the “show-stoppers” and the questions to ask; managing client expectations around privacy and security risks; and best practices during the lifecycle of the transaction.
