On April 23, 2024, the United States Federal Trade Commission voted – 3-2 – to adopt a rule all but banning employment noncompete agreements. The rule is slated to go into effect 120 days after its publication in the Federal Register. The rule would allow existing noncompetes with senior executives, defined as workers earning more than $151,164 annually and who are in policy-making positions, to remain in force. Once the rule takes effect, employers would be banned from entering into noncompetes with employees, even with senior executives.
