Ice Miller Bolsters Cleveland Presence with Veteran Construction Litigators
Michael Pascoe and Robert Port Join Ice Miller’s Newest Ohio Office from Hahn Loeser
Ice Miller is pleased to announce that partner Michael Pascoe and of counsel Robert Port have joined the firm’s recently established Cleveland office. Both seasoned litigators bring decades of experience managing a wide range of complex commercial litigation matters, with a strong focus on construction disputes. Collectively, their background spans high-profile trial work, class actions, large-scale development projects, and national Occupational Safety and Health Administration (OSHA)-related matters, among other areas of law.

They also fortify our national construction litigation practice, rounding out an already strong bench in that space.”
Pascoe represents clients across the country in state and federal court, as well as before the American Arbitration Association (AAA). He focuses on the full gamut of commercial litigation matters, handling construction disputes, breach of contract claims, facilities management litigation, and business claims. He also provides strategic counsel to clients on contract negotiation, commercial lease negotiations, and construction contracts, with a particularized focus in dispute avoidance during construction projects.

Additionally, Pascoe frequently represents clients across the country before the Occupational Safety and Health Review Commission. He also counsels clients on OSHA enforcement response strategies and helps negotiate and resolve citations prior to litigation. Pascoe also regularly presents on new and emerging issues in OSHA rulemaking and enforcement in the construction industry.
Port focuses on business litigation, construction litigation, complex commercial disputes, and construction law, and has represented clients nationally in class-action lawsuits. In the construction space, he handles claims regarding additional costs and scheduling impacts, pre-litigation claims management to mitigate risk and reserve the client’s potential future claims for additional compensation or contract time extensions, assisting clients in obtaining certification under various Ohio and federal programs for minority or disadvantaged business entities, and defending clients against decertification for state and federal programs. His experience also includes business tort litigation, representing both plaintiffs and defendants, nationally, including breach of contract, tortious interference with contractual relations, misappropriation of trade secrets, and breach of fiduciary duty, as well as analyzing business financial information and developing damages models based on both lost profits and business valuation.
Of particular note, Port holds a master’s degree in mechanical engineering and worked as a research-and-design engineer for over a decade, equipping him with a unique perspective in his approach and counsel.
